1. Scope

These Terms and Conditions apply to all orders placed through the Studio James online store by consumers.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.

3. Conclusion of Contract

The presentation of products in our online store does not constitute a legally binding offer, but an invitation to place an order.

By adding products to your cart and completing the checkout process, you submit a binding offer to purchase the products contained in your order.

The purchase contract is concluded when we accept your order, for example by sending an order confirmation or shipping confirmation.

4. Products and Personalization

Studio James offers handmade and customizable products. Depending on the selected product, customers may be able to choose options such as leather color, cord color, hardware, embossing, charms, notebook inserts or other customization options.

Customers are responsible for ensuring that all personalization information submitted with their order, including names, initials, wording and other selections, is correct.

Please carefully review all customization details before completing your order.

Due to the nature of genuine leather and handmade products, slight variations in color, grain, texture and appearance may occur. These natural characteristics are not considered defects.

5. Prices and Payment

All prices displayed in the online store are shown in the currency applicable to the respective market.

Shipping costs, where applicable, are displayed during checkout.

Available payment methods are displayed during the checkout process.

6. Shipping and Delivery

We ship to the countries and regions available for selection during checkout.

Applicable shipping costs, free-shipping thresholds and estimated delivery times can be found in our Shipping Policy.

Delivery times are estimates and may be affected by circumstances outside our reasonable control, including carrier delays or customs processing.

For deliveries outside the European Union, additional customs duties, import taxes or other charges may apply. Unless otherwise stated, these charges are the responsibility of the customer.

7. Right of Withdrawal

Consumers may have a statutory right of withdrawal. Details regarding the right of withdrawal, applicable deadlines and the procedure for exercising this right can be found in our Right of Withdrawal / Withdrawal Policy.

The statutory right of withdrawal may not apply to goods that are made to the consumer’s specifications or are clearly personalized, where the legal requirements for this exception are met.

This may apply, for example, to products individually produced or modified according to customer-selected personalization such as custom embossing.

Products that are not personalized remain subject to the applicable statutory withdrawal rights.

8. Returns

Please refer to our Withdrawal Policy for information regarding eligible returns, return periods and return shipping costs.

Unless otherwise required by applicable law or the product is defective, customers are responsible for the direct cost of returning eligible products.

9. Defective Products and Statutory Rights

Statutory warranty rights apply.

If an item arrives damaged, defective or incorrect, please contact us as soon as possible at team@studio-james.co, including your order number and, where helpful, photographs of the issue.

Nothing in these Terms and Conditions limits any mandatory statutory rights to which consumers are entitled.

10. Intellectual Property

All content made available through Studio James, including designs, photographs, graphics, logos, texts and other original content, may be protected by applicable intellectual property laws.

Such content may not be reproduced, distributed or commercially used without prior permission where such permission is legally required.

11. Liability

We are liable without limitation where liability is mandatory by law, including in cases of intent and gross negligence and for injury to life, body or health.

Any further liability is governed by applicable statutory provisions.

12. Applicable Law

The law of the Federal Republic of Germany applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

For consumers, this choice of law does not deprive them of mandatory consumer protection provisions applicable in the country of their habitual residence.
